Participant Waiver of Liability & Photo Release

Telford Happenings reserves the right to deny any vendor for any reason from participation in our events or sponsorship opportunities.

By marking the Terms & Agreements checkbox on the sign-up page, I and, if applicable the company/organization I represent (Vendor) release Telford Happenings, Inc., the Borough of Telford and Perseverance Fire Co. from all liability relating to injuries, illnesses, damages, or loss that may occur while participating in events or activities sponsored by Telford Happenings, Inc.. Vendor assumes all responsibility for any risks associated with participation in events or activities sponsored by Telford Happenings.

Liabilities

In consideration for Telford Happenings, Inc. allowing Vendor to participate in sponsored activities, Vendor hereby voluntarily agrees to assume all of the foregoing risks and accept sole responsibility for any injury to representatives of the Vendor including, but not limited to, personal injury, disability, death, illness, damage, loss, claim, liability, or expense, of any kind, that Vendor may experience or incur in connection with attendance. Vendor hereby releases, covenant not to sue, discharge, and hold harmless Telford Happenings, Inc., volunteers, board members, and staff of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. Vendor understands and agrees that this release includes any claims based on the actions, omissions, or negligence of the Telford Happenings, Inc., volunteers, board members, and staff.

Vendor agrees that Telford Happenings, Inc., volunteers, board members, and staff of the Telford Happenings, Inc. have full discretion to ask individuals to leave an event or activity if Vendor shows symptoms of illness or a temperature over 100.4°, exhibits unsafe behaviors, places others in danger, uses vulgar or threatening language, makes any members of the public or staff feel unsafe, appears to be under the influence of illegal drugs, initiates violence, or refuses to sign this waiver. Telford Happenings, Inc. is under no obligation to issue a refund for any services, purchases, or donations.

Photo Release

Vendor gives my consent to be recorded by photo, video, or audio during participation whether Vendor explicitly poses or appears candidly in event photos, videos, or audio recordings, and Vendor understands those materials are the property of the Telford Happenings, Inc. Photos, videos, and audio recordings may be used, published, or posted to social media at the discretion of Telford Happenings, Inc. without notice or payment to subjects. As the owner of photos, videos, and audio recorded by Telford Happenings, Inc., volunteers, board members, and staff, Telford Happenings, Inc. maintains the right to use those materials for marketing and advertising purposes without notice or payment to subjects.
